All the makings of a police state
The events since Friday make extremely depressing reading for anyone remotely concerned about the state of the nation. The continued virtual house arrest of the suspended chief justice of Pakistan, Justice Iftikhar Mohammad Chaudhry, is a black spot on this government that will be difficult — one would say, almost impossible — to erase from public memory. As if the humiliation of Justice Chaudhry being summoned to Army House and being asked to explain to the president (wearing army fatigues) the allegations contained in a now-controversial letter was not enough, one now learns that since Friday the suspended chief justice of Pakistan and his family have had their telephone lines disconnected, their mobile phones taken away and have been prohibited from watching television or reading newspapers. According to several reports, most quoting Justice Chaudhry’s family members, the house of the suspended chief justice is swarming with officials of the intelligence agencies and no one is allowed to enter the premises, though retired air force chief Air Marshal Asghar Khan did manage to argue and walk past the guards and meet Justice Chaudhry.
In doing all of this, the government has clearly overstepped its authority. Justice Chaudhry, if Article 209 has been followed and read properly, has had a reference filed against him for misconduct and abuse of office. However, preventing him from meeting people and restricting his and his family’s movement, and not letting him establish contact with anyone outside his residence gives the impression as if the government considers him a dangerous criminal who is a clear and present danger to society. What the government has been doing since Friday is only going to exacerbate the crisis and lower its credibility — already quite low — in the eyes of (it can be safely said) most Pakistanis because they will think that if this can happen to a chief justice of the Supreme Court then ordinary citizens might just as well forget about receiving their constitutionally guaranteed right to due process and a fair hearing.
By denying the suspended chief justice the right to move around freely, to meet whoever he wishes or even to talk to the media, the government is in violation of the Constitution, and specifically of the constitutional process by which a member of the Supreme Court is to be removed from office. Surely, the president, the prime minister, members of the federal cabinet and even the brother judges of Justice Chaudhry would agree that his is a case of convicting without even being given a fair hearing. Surely, it can be seen that Article 209 does not authorise the president, or anyone for that matter, with the power to restrict the physical movement of a judge against whom a reference has been filed and to bar him from using any link to the outside world. A lot of damage has already been done by this full frontal assault on the judiciary of the country.
Of course, no one should defend a judge, no matter how august he may be, if he indulges in conduct unbecoming of his office and misuses his official powers. But allegations should not be equated with proof and conviction — something that the government’s actions suggest is the case — and the method and process outlined in the Constitution need to be followed. This constitutional method does not have any provision for physically restricting a judge under investigation from moving about freely and stripping away his officially entitled privileges — the latter can be done only after the investigation has been carried out and a recommendation for removal made by the Supreme Judicial Council and acted upon by the president. Even in that eventuality, the action should not be seen as high-handed and vindictive — which seems to be the case now, despite the fact that the charges against Justice Chaudhry remain mere allegations. As has been reported widely, on the day of his suspension following the filing of the presidential reference, Justice Chaudhry was stopped from entering the premises of the Supreme Court building and escorted to his house by a senior police official. Even now, with a reference filed against him but none of the charges proved, the suspended chief justice should be free to visit his office if he so wishes because there is nothing in the Constitution that prevents any judge of the Supreme or High Courts, and against whom a reference has been filed with the Supreme Judicial Council, from attending his office.
There is one other point as well: ministers should not consider the people of this country to be bumpkins who cannot see what is going on. When told that Air Marshal Asghar Khan had met Justice Chaudhry who told him that he (Justice Chaudhry) had no access to the phone, TV or newspapers, one member of the federal cabinet expressed surprise and then went on to say that this itself was proof that the chief justice was free to meet people. Surely, the hordes of journalists, politicians and well-wishers standing outside the gates of Justice Chaudhry’s official residence and denied entry by the security staff posted there speak of an entirely contrary situation, one that really puts official claims that he is free to meet anyone to shame. The government needs to extricate itself from this ugly situation before it spirals out of control. Any delay in repairing the damage can only convince most Pakistanis that they live in a country that has all the makings of a police state. Also, equally importantly, the government needs to understand that for the sake of its own credibility this farce needs to come to an end.
In societies two types of culture exist: High context culture vs. Low context culture . No one is better over other. It is the pretext of this which judges an IQ of a person [ http://en.wikipedia.org/wiki/Intelligence_Quotient ]. Regardless of what degree/education one might get, If IQ can not be analysed very early then after 18 years it cannot grow further.
Look through this and one might find that it effects everything in our society. A good analytical person should not get deviated doing things like protesting on streets where they know that others with low IQ will be involved.

Speaking of democracy, PEMRA has been asked to cancel the licenses of all channels who are discussing CJ case openly. It is also worh mentioning that the profile of CJ iftikhar has been restored on Supreme COurt website.

police intercepted him in front of Baluchistan house and tried to drag/force him into the offcial flagged car which he sternly refused to use until his name is cleared.. now he has been confined in Baluchistan House and being persuaded to board his official car…

The whole thing has created a very serious judicial/legal crisis. By taking and giving oath of CJ while CJ is still present, judges have disqualified themselves as SC justices.

While we are all upset at the deplorable methods used by the President against the CJ, I would advocate patience and rationality here. For sake of justice (if that can be in Pakistan), let us wait and watch the process. Both sides need to be heard. Let the hangings commence later.

Supreme Judicial Council’s constitution has also been challenged so that will also be a issue.. plus Ahtizaz Ahsan says that even if acting CJ Jawaid Iqbal has been choosen citing the 2nd senior most judge Justice Bhagwandas was on leave… still for the supreme judicial council(SJC) the rules clearly state that only Rana Bhagwandas will head its proceding doesn’t matter if he is on leave or holidays or anywhere in the world ,its only him that can head the SJC
among the 5 justices sitting on SJC , 3 are known to be biased against CJ Iftikar and 2 are pro CJ Iftikar… so the verdict will be 3:2 in favour of govt… now CJ Iftikhar should pray that Bhagwandas comes back where ever he is so that things can go in his favour.. but currently the majority of these judges are tilted towards govt…

I don’t care, says Wasi, of his fate after letting son thrash a passenger

ISLAMABAD: Prime Minister Shaukat Aziz and Pakistan Mulsim League President Chaudhry Shujaat Hussain will decide the fate of Law Minister Wasi Zafar once they are back home.
The uncertainty around his future has risen following the Karachi airport incident in which his son allegedly thrashed a PIA passenger in his presence. The ruling Pakistan Muslim League is all set to bring the case before top party bosses.
Tariq Azeem, PML information secretary and minister of state for overseas Pakistanis, told The News that the matter would be brought before the Prime Minister and the PML president as soon as they return from abroad. Azeem said both the leaders are returning home today.
“No-one is above the law,” he said, adding the party would ascertain the facts of the case and take a decision accordingly. Reacting to the development, Wasi Zafar said “I don’t bother, I don’t care”.
When Wasi was contacted on his mobile, he showed no interest in giving his side of the story. Shunning the opportunity to clear his position and give his side of the story, the law minister repeatedly said he did not care.
“Write against me whatever your want. I don’t care,” he said, adding that already a lot has appeared against him. According to newspaper reports, one Mujeeb Khan received injuries when, Umair, the law minister’s son, gave him a drubbing in the presence of his father and several others at the entrance of Jinnah International Terminal last Wednesday.
These reports say the incident occurred when Khan objected to the law minister and his son proceeding to the reporting counter without routine checks. Khan was rescued by the ASF men present there.
Raja Anwar, assistant sub-inspector police Karachi Airport police station, said he read about the incident in the newspapers but was not otherwise informed about it. He said the police also did not receive any complaint, without which they could not proceed against anybody.
Referring to a local newspaper report, the ASI said the victim was quoted as saying he would not lodge his complaint against the minister and his son in Karachi but in Islamabad, his destination.
Airport Security Force (ASF) men in Karachi also shied away from offering comments on the incident. Their airport chief, Abdul Wadood Khan, was not in the office but others were tight-lipped.
A source, however, said a report on the incident has been filed by the ASF officials and sent to the higher authorities. Khan was inaccessible and his mobile was not responding. Interior Secretary Syed Kamal Shah’s also seemed not to have read the newspaper accounts on the subject but he vowed to immediately talk to the inspector general Sindh to get a report on the matter.
When told about the reported details, he said if it had happened inside the airport then ASF should have taken some action. IG Sindh Asad Jehangir was also contacted but he was said to be busy in a meeting. He failed to return the call.

I just heard the voa interview and I got shocked that he used such words on an International radio station in the presence of lady. Some form of enlightment I guess.
anyway,mushi’s own buddies are creating troubles for him. first naeem,then arbab ghulam and durrani and now Wasi Zafar. Intertional news agencies,one of them is from france are planning to write letter to Dictator to take actions against Wasi for his offensive behaviour against a journalist.
On the other hand, Punjab bar has issued showcause notices to Wasi Zafar and the advocate for his offensive tone as well as notification of banning channels respectively. They have been asked to appear on 20th march.
What i see that pro mush are in hibernation mode now. Are they hiding face due to embarassment and shame or they are just not able to digest the real face of their beloved dictator?

when too much steam use to built up in past then either PM use to kick the president or President use to kick the PM or Army Chief use to kick both of them… now at present President and army cheif are same and PM is also his own dummy … so either he him self will be kicked by crop commander pindi or maybe he’ll declare a full fledge marshall law… out of frustration… coz things are really heading towards total chaos….

doc, mush is not a politician but then it’s a reality that he’s our president. In Pakistan you don’t need a degree, all you need a “danda” and I am use Wasi was saying all that stuff on the behalf of Foji Danda which he considers more powerful than a God.
But I must agree that politicians are just cashing the event to vomit out their frustration against Musharraf. It was funny to watch that Nawaz shareed addressing Karachi bar council via Mobile call. *sigh*

By virtue of that statement and by agreeing with it, you all are accepting that all five judges of the Supreme Court are unfair, partial, prejudiced and subjective. Hardly a qualification for any law keeper leave alone for the justices of the highest court of the land.
True or not, I cannot fathom how you can gulp this with so much ease and digest it so easily.
I too abhor the methods used in this country to remove people from their posts, this is not the first time and in all probability not the last time either. However blindly proceeding as a mob for lynching will hardly get you any justice in the end.

if you ever get a chance to pass through Wasi zafar’s home town Jaranwala then you’ll notice the wall chalking against him on every street… i mean if this guy stands for a local councilor seat.. he will miserably loose that election too i dunno how he managed to win MNA seat … only logical reason that he is a MNA is coz his brother is a senior military figure in defense ministry…
i just hope that poor Ansar Abassi and his family are fine.. coz both Durani and Wasi zafar are annoyed with him
